Electric shock injury and electrical death cases are very different from other types of personal injury cases. They require an attorney with critical experience, knowledge and skill. It might surprise you to learn that nearly every personal injury lawyer and law firm in the Golden State that markets and advertises for electrical injury/death cases has never even handled one!

In stark contrast, an experienced electrocution accident lawyer has the ability to secure for you the best possible settlement for your California case.

The Most Experienced California Electrocution Accident Lawyer

Few other California personal injury attorneys in the country have tried as many electrical death and electric shock injury cases as electrocution accident lawyer Jeffrey Feldman has during his more than 35 years of practice throughout the nation.

He has won multi-million-dollar verdicts and settlements for his clients in many states across the nation. In just the past two years, he has secured a nearly $15 million settlement for electrical injuries in an industrial workplace incident and a $13.5 million settlement for a wrongful death resulting from an electrical fire. While every case is different, there is a reason why Jeff Feldman has become the “go-to” attorney that attorneys across the country seek out to refer these electric shock and electrical wrongful death cases to. Arguably, there is no attorney in America today who has handled as many or who has as much experience in this highly complex area of law as Jeff Feldman does today.

Electrocution accident lawyer Jeffrey Feldman has been helping families of electrical death and electric shock injury victims from California and all around the country for over 35 years. He is the attorney you need for your case.

Settlements And Verdicts

Electrocution accident lawyer Jeffrey Feldman has won multi-million-dollar verdicts and settlements for injured  victims and for families of deceased victims in California and all around the country for over 35 years.

Here are a few recent examples:

  • Nearly $15 Million – This settlement was for electrical injuries caused by an industrial workplace incident.
  • $13.5 Million – This wrongful death settlement was obtained in a case where a family lost their loved one in an electrical fire.
  • $6 Million – We won this verdict after a jury found for our client who was injured as a result of a utility’s negligent installation and maintenance of power lines. The defense’s highest settlement offer was only $75,000.
  • $4.55 Million – We secured this settlement for the family of a communications worker who was killed due to an electrical utility company’s negligence.
Jeff was so compassionate toward me and my husband at the time, and pretty much anybody involved. He just had a way of making you feel comfortable with him. We just really struck up a rapport with him, and it was genuine. He was genuinely concerned about this happening and felt that he needed to fight for us.

- Loretta Balotta, Former Client

Electrocution cases are a niche. Defense experts for utility companies are the best in the U.S. and it takes an expert to fare against their seemingly unlimited resources and power. The cases are so labor intensive and require you to work around the clock, as the defense team can be up to six or seven attorneys. Jeff brings the intensity those cases require.

- Rick Arcaro, Attorney

I met Jeff about 40 years ago and during that period of time, I’ve had the opportunity to work with him on cases, so I’ve had the opportunity to see how he works. He’s very, very specific in what he does. He’s very good at what he does. He delves into all the medical and all the liability issues. He’s somebody that I believe personally is one of the smartest, most conscientious attorneys in the State of Michigan.

- Leonard Koltonow, Attorney

Common Victims Injured by Electricity

Our electrocution accident lawyers know that incidents with electricity can happen to anyone in California, and they can occur anywhere where there is exposure to electrical currents, but certain types of occupations and classes of individuals  are more susceptible than others. Construction workers, electricians, and maintenance personnel are always at higher risk due to their frequent exposure to electrical equipment. However, it is crucial to note that these types of incidents can occur in any setting, affecting people of all ages and backgrounds.

Here are some of the most common victims:

Places Where Electrical Injuries Can Occur

Our electrocution accident lawyers know electric shock injuries can happen anywhere in California. Here are a few of the most common places where electrical injuries can happen:

Who Can Be Liable For Paying For Electrical Injuries and Death?

Our electrocution accident lawyers know that any person, entity, business, corporation, or electrical utility company in California may be liable for your electrical injuries – or for your loved one’s death from a fatal electric shock – if they failed to exercise reasonable care to keep you or your loved one safe and their failure caused your injuries or resulted in your loved one losing his or her life.

Our electrocution accident lawyers understand that under California law, “[e]veryone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person . . .” (Civil Code Section 1714(a))

Similarly, “[p]eople and companies must be very careful in constructing, insulating, inspecting, maintaining, and repairing power lines and transmission equipment at all places where it is reasonably probable that they will cause harm to persons or property.” (Civil Jury Instructions (CACI)(2023) No. 416)

The people, entities, businesses, corporations or companies that may be liable for electric shock injuries and death include:

  • Employers
  • General contractors
  • Subcontractors
  • Property Owners
  • Product and equipment manufacturers
  • Electrical utility companies

Employers and Workers’ Comp Insurance

If you’re injured by an electric shock or a loved one comes in contact with electricity and dies at work due to the negligence of your employer – or a co-worker – then you may be able to file a Workers’ Compensation claim against your employer for benefits to pay for your medical bills and to pay you wages that you have otherwise earned if your injuries hadn’t disabled you from working.

Unfortunately, you will not be able to sue your employer for compensation for your pain and suffering because the states Workers’ Comp law contains an “exclusive remedy” provision that prohibits such compensation from being recovered from employers. (Labor Code Section 3602(a)) The trade-off for injured workers is they can claim medical and wage loss benefits on a “no-fault” basis, meaning they do not have to show that their employer was at-fault.
However, your electrocution accident lawyer may be able to bring a claim for pain and suffering compensation against a negligent third-party in California who is neither your employer nor a co-worker.

Companies Who Make Defective Products

In California, if you suffered injuries or a family member died as a result of a electric shock that was caused by a defective product, you may be able to hire an electrocution accident lawyer to bring a lawsuit for pain and suffering compensation and money damages.

If the defective product involves a manufacturing defect, a design defect, or defective warnings, then you may be able to bring your claim against the manufacturer, designer or seller of the product on a strict liability basis.

Alternatively, if the product you purchased in California was defective because it was negligently designed, manufactured, supplied, installed, inspected, repaired or rented, then an electrocution accident lawyer may be able to bring an ordinary negligence claim against the responsible parties.

Land Owners

In California, if you suffered an electric shock injury or a loved one died because a land owner, property owner, or business failed to keep their property or premises for visitors safe, then you may be able to hire an electrocution accident lawyer to bring premises liability claim against the responsible parties to compensate you for your pain and suffering and to pay for your medical bills and lost earnings if you couldn’t work because of your injuries.

Under state law, land or property owner has a duty to (1) “use reasonable care to keep the property in a reasonably safe condition” and (2) “use reasonable care to discover any unsafe conditions and to repair, replace, or give adequate warning of anything that could be reasonably expected to harm others.”

Failure to carry out their duty to keep their property safe means that the land owner or property owner is negligent.

Wrongful Death Claims

If a fatal electrical accident has taken the life of your loved one in California, you and your family may be able to recover compensation and damages by hiring an electrocution accident lawyer to file a wrongful death lawsuit against the negligent parties who are responsible for your loved one’s death.

Under state law, such a lawsuit must be filed by the personal representative of your loved one’s estate or by his or her successor interest.

The compensation and damages that may be recoverable in a wrongful death case may account for: (1) pain and suffering, (2) loss of your loved one’s financial support, (3) loss of gifts or benefits from your loved one, (4) funeral and burial expenses, (5) the reasonable value of hiring someone else to perform the household services that your loved one previously undertook, (6) the loss of your loved one’s love, companionship, comfort, care, assistance, protection, affection, society, moral support, consortium, as well as training and guidance, (7) punitive or exemplary damages. (Civil Jury Instructions (CACI)(2023) No. 3921)

Why Do I Need An Electrocution Accident Lawyer For A Case In California?

The most important reason you need an experienced electrocution accident lawyer for your California lawsuit is because these cases are initially fought and defended very aggressively by utility and power companies. This is a scare tactic they use to intimidate and harass attorneys who are not electric shock attorneys into settling their clients’ case for far less money than the case is actually worth.

It is essential for you and your family to get the best possible settlement to cover your pain and suffering compensation, medical bills and lost wages and earnings.

The best and only way for you to get the financial recovery in your California case that you deserve is to have an electrocution accident lawyer with the experience and specialized knowledge to fight for the compensation and damages you’re legally entitled to.

Here are the things that a California electrocution accident lawyer will do for you:

  • Determine all of the people, entities, businesses, companies and corporations who are liable for your injuries or a loved one’s death
  • Determine the amount of insurance coverage that is available to pay what’s owed to you
  • Determine the amount of financial assets that the responsible parties have available to contribute to you settlement
  • Identify violations of the National Electrical Safety Code (NESC) and the National Electrical Code (NEC)
  • Recruit the nation’s top experts in fields such as: (1) power infrastructure, (2) electrical engineering, (3) mechanical engineering, (4) reliability engineer, (7) the National Electric Safety Code and the National Electrical Code, (8) an economist, and (9) medicine and rehabilitation to address injuries, surgeries, and present and future medical needs
  • Negotiate with the insurance companies
  • Try your case to a jury if the insurance company refuses to settle for the full value of your claim

How Do I Choose The Best Electrocution Accident Lawyer For My Case In California?

When choosing to hire an electrocution accident lawyer for your case in California your attorney should have the following qualities:

  • Experience – You want an attorney with real experience litigating electrical deah and electric shock injury cases. Pretending to be an “electric shock attorney” in an advertisement or commercial, or having handled one case years ago or having gone to a few weekend CLE seminars does not count. When the negligent parties deny their responsibility and refuse to acknowledge what they’ve done to you, it’s the experience of your attorney that will make the difference between you being taken advantage of and you holding the negligent parties accountable.
  • Specialization – You want an attorney who specializes exclusively in this area of the law. In these types of cases in California, an experienced and specialized electrocution accident lawyer will know how to use the law to get you the best possible settlement and how to avoid the traps and pitfalls that can ruin your case.
  • Track record of success – You want an attorney who wins cases. Ask about their trial verdicts and settlements. How much were they? What were the cases about?
  • Reputation for results in electrical death and electric shock injury cases – When choosing an electrocution accident lawyer for your case in California, this matters. Especially to the insurance companies who are trying to decide whether to try to bully you and your attorney into taking a low-ball settlement offer or to negotiate in good faith to reach a settlement that reflects the true value of your case. Power and utility companies defend these cases to a large extent based on who your attorney is. Attorneys with a track record of success in handling electrical death and electric shock injury cases tend to settle their clients’ cases for significantly more money and often faster than electric shock attorneys who don’t have a track record of success. However, California personal injury attorneys who pretend in their advertisements and commercials to be “electrocution accident lawyers” even though they’ve never actually taken one of these specialized to trial tend to face much more aggressive tactics by the power and utility companies in their defense of the case, with the end goal being to make the case as protracted and expensive as possible so the attorney will pressure his or her client into accepting a “low-ball” settlement offer that is well below what the case is actually worth.

How Much Does An Electrocution Accident Lawyer Cost In California?

In California, it won’t cost you one penny out of your pocket to hire an electrocution accident lawyer. And what you end up paying with our law firm may be a whole lot less than what you pay at other law firms – even those who lack our track record of success in electric shock injury cases and who do not specialize exclusively in this specialized area of law.

We don’t charge you anything to get started on your case and we don’t ask you to make any payments towards our fee or costs unless and until we have recovered a winning settlement or verdict for you. And that happens only after your whole case is done.

How Long Does a Settlement Take?

You could reach a settlement in your case in a matter of months if no lawsuit is filed. Cases resolve much quicker before the courts get involved. However, our electrocution accident lawyers know it generally takes 1 to 2 years to settle a case once a lawsuit is filed for a case in California. If the case goes to trial, the timeline may extend even longer.

If you’re trying to ballpark how much time a settlement may take in your case, here are some things to consider:

  • Your injuries
  • What your medical needs are now and what they will be in the future
  • Whether you’re disabled from working and how your injuries may affect your future work life
  • The experience, specialization, track record and reputation of your attorney
  • How conclusively the evidence establishes the defendant’s liability
  • The defendant’s insurance company
  • The defense attorney
  • The judge assigned to the case
  • The court where the lawsuit is filed (and whether the court has a backlog of cases)
  • Whether it will be difficult (and time consuming) to serve the defendants with the lawsuit
  • Deposing all of the parties, expert witnesses and occurrence witnesses (i.e., people who witnessed the incident, itself, or other relevant events)
  • Mediation and facilitation
  • Settlement negotiations
